Welcome to ARC: Train + Recover, a brand operated by PT. Alam Bugar Semesta ("ARC", "we", "us", or "our"), an Indonesian limited-liability company (perseroan terbatas) incorporated in Jakarta. These Terms and Conditions ("Terms") govern your use of our facilities, services, and website (www.arcperform.id). By booking a session, purchasing a membership, or entering our premises in Jakarta, you agree to be bound by these Terms.

1. Membership & Bookings

All sessions, classes, and recovery services must be booked in advance through our official channels (phone, WhatsApp, Instagram, or in person). Bookings are confirmed once payment is received in full or as otherwise agreed at the time of booking. ARC reserves the right to refuse, reschedule, or cancel any booking at its sole discretion.

2. Pricing & Payment

All prices are listed in Indonesian Rupiah (IDR) unless otherwise specified, and are inclusive of applicable taxes where required. Pricing is subject to change without prior notice; the price in effect at the time of booking applies to that booking. Accepted payment methods are listed at the studio and on our official channels.

Payment gateway. Online and card-based payments are securely processed by our third-party payment provider, PT Midtrans (the "Provider"). All transactions are processed in the currency specified at checkout. By submitting a payment, you agree to the Provider's own terms and privacy practices. ARC is not responsible for errors, delays, downtime, declined transactions, or other issues originating from the Provider's system, the issuing bank, or the card network, except where caused by ARC's own actions.

Processing fees. Unless explicitly stated otherwise at checkout, ARC bears the standard payment-processing fees charged by the Provider. Where a specific payment method (for example, international credit cards or certain instalment plans) attracts a surcharge, that surcharge will be disclosed before you confirm payment and will be borne by you, the customer.

3. Cancellation & Refunds

Cancellations made at least 24 hours before a scheduled session may be rescheduled at no charge. Cancellations within 24 hours of the scheduled session, or failure to attend ("no-show"), are non-refundable and may be charged in full.

Memberships, packages, and prepaid credits are non-refundable except as required by Indonesian law. Unused credits expire as stated at the point of purchase.

How refunds are processed. Where a refund is approved, it will be returned to the original payment method via our payment provider, PT Midtrans. Refunds are subject to the Provider's processing rules and timeframes, which typically range from a few business days (e-wallet and virtual-account methods) up to fourteen (14) business days or longer (credit card, depending on the issuing bank). ARC is not liable for delays in refund settlement caused by the Provider, the issuing bank, or the card network. To request a refund, contact us using the details in Section 11.

4. Health, Risk & Personal Responsibility

Use of the gym, cold plunge, infrared sauna, and recovery facilities involves inherent risks including but not limited to injury, illness, and aggravation of pre-existing conditions. By using our facilities you acknowledge that you:

ARC reserves the right to refuse access to any individual whose participation, in our reasonable judgement, poses a health or safety risk to themselves or others.

5. Facility Rules & Code of Conduct

All members and guests are expected to behave with respect toward staff, other members, and the facility. We do not tolerate harassment, discrimination, intoxication, or unsafe conduct of any kind. ARC may terminate a session, membership, or right of access — without refund — for any breach of these rules.

Personal belongings are stored at your own risk. We strongly recommend using the lockers provided. ARC is not liable for loss, theft, or damage to personal property on the premises.

6. Photography & Media

ARC may occasionally photograph or film sessions, classes, events, and facilities for promotional and educational purposes. By entering the premises you consent to being captured in such media unless you notify our staff in writing in advance that you do not consent. Members and guests may not photograph or film other people in the facility without their explicit consent.

7. Privacy

Personal information you provide to ARC (including contact details, health declarations, and booking information) is collected and processed in accordance with applicable Indonesian data protection laws — including the Personal Data Protection Law (UU No. 27 of 2022, "UU PDP") — and used solely for the purposes of operating our services, contacting you, and complying with legal obligations. We do not sell your personal information to third parties.

Payment data. Sensitive payment details — including credit and debit card numbers, CVV codes, and bank account credentials — are collected and processed directly by our payment provider, PT Midtrans, in accordance with the Provider's security standards and applicable industry requirements (including PCI DSS). ARC does not store full card numbers or CVV codes on its own systems. Use of the Provider is also governed by the Provider's own privacy policy, which you should review when making a payment.

8. Limitation of Liability

To the maximum extent permitted by Indonesian law, ARC's total liability to you in connection with these Terms, your membership, or your use of our facilities is limited to the total fees you paid to ARC in the twelve (12) months preceding the event giving rise to the liability. ARC will not be liable for indirect, incidental, or consequential damages.

9. Changes to These Terms

ARC may update these Terms from time to time. The most current version will always be available at www.arcperform.id/terms.html. Material changes will be communicated to active members via the contact details on file. Your continued use of our facilities after an update constitutes acceptance of the revised Terms.

10. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Jakarta (Pengadilan Negeri Jakarta Selatan), unless otherwise required by mandatory consumer-protection law.
